mivakami’s terms of service

1. workflow & delivery

Commission requests may be submitted through my website or Discord (@mivakami). I will confirm the details, price, and estimated timeline before work begins. Timelines are estimates and may vary depending on complexity and availability; I will communicate significant delays. Finished files are delivered through Discord, email, or Google Drive and retained for at least 7 days after delivery. Please save your files during this period! Original files in a .clip or .psd format are available upon request.

2. payment & additional fees

Payments are accepted through PayPal or Ko-fi. Payment is due within 24 hours of quote approval unless another arrangement is agreed upon. Payment plans may be available for commissions over $35 with prior approval and must be completed within one month.

Additional fees:

• Wings/props: +$1–10
• Complex character: +20–50%
• Each additional character: +75%
• Rush / Priority request (less than 3 days, bump to top of queue): +50%
• Private commission: +100%
• Suggestive content: +100%
• Spicy/NSFW content: +200%

All applicable fees will be disclosed before payment and require your approval. Rush fees do not guarantee a deadline; deadlines depend on complexity, workload, and artist approval.

3. cancellations & refunds

Refunds depend on the work completed, payments made, and circumstances. A full refund is generally available if work has not started or I am unable to complete the commission. Partial refunds may apply once work has begun. I will explain the calculation and any deductions. If a significant delay occurs, I will communicate with you about the revised timeline and available options.

If a commission is cancelled, unfinished work may be reused as a generic YCH/base, but your character, identifying details, and private references will not be included. A legitimate payment dispute or good-faith complaint will not automatically result in blacklisting. Nothing in these terms removes rights that cannot legally be waived.

4. accepted & declined work

I accept character artwork featuring a variety of species, including canines, felines, reptiles, birds, and dragons. Suggestive or NSFW anthro commissions are only available to adults with anthro characters, both clients and characters aged 18 or older.

I do not accept gore fetish, mecha, sexual content involving minors, zoophilia, hateful or extremist promotional content, or requests outside my boundaries.

5. artwork copyright & AI prohibition

I retain copyright to all artwork I create. Clients receive personal-use rights unless commercial use is approved with an additiona in writing. You may share your commissioned artwork with credit to @mivakami and use it on personal profiles. You retain ownership of your own characters; purchasing artwork does not transfer copyright.

AI use is strictly prohibited. My artwork, designs, and commissioned materials may not be uploaded to, used for, or distributed for AI training, datasets, AI generation, or unauthorized AI edits or derivatives.

You may not claim my work as your own, remove watermarks, redistribute or resell my artwork, mint it as an NFT, or use it for cryptocurrency-related projects without my written permission.

6. adopts, YCHs, resales & auctions

• Resale limits: Adopt designs may not be resold for more than their original purchase price unless additional artwork, commissioned media, or other paid additions have been purchased for that design. Any increased price must reasonably reflect those additions.
• Free, gifted, or raffled designs: These may not be sold unless paid additions have been made. They may still be gifted or traded.
• Auctions: Bids are binding. Only bid if you intend and are able to pay. Winners must pay within the stated deadline or an agreed timeframe. Failure to pay may result in cancellation, blacklisting, or refusal of future participation.
• Design credit: Credit me as the original designer when reasonably possible. Do not claim my designs as your own creations.
• Design changes: You may modify your adopt, but may not copy or create a near-identical version of another person's design.

7. commercial use & private commissions

Commercial use includes merchandise, branding, advertisements, mascots, and monetized projects. Written permission and an additional fee may be required. Commercial permissions are not transferable unless agreed upon in writing. Permission to use a character commercially does not automatically grant rights to my artwork depicting it.

Private commissions include a 100% fee, and I agree not to publicly post or use the artwork for my portfolio or promotion. I will not intentionally publish private references or personal information.

8. revisions & communication

Reasonable corrections may be requested if the artwork materially differs from the approved brief. Requests that change the original scope may require an additional quote and your approval. Both parties are expected to communicate respectfully, and clients may raise concerns in good faith without being penalized solely for doing so.

Clients are entitled to 3 revisions before additional fees may incur. This does not include fixing mistakes, as they are exempt from revisionary guidelines.

9. violations & updates

Violations may result in cancellation of an order, blocking, blacklisting, or refusal of future services, depending on the circumstances. These terms may be updated for future orders. The version in effect when you place your order will apply unless otherwise agreed or required by law.

By submitting an order, approving a quote, or purchasing an adopt, you acknowledge that you have read and agreed to the applicable terms.
